A. Cancellation Policy
Introduction
Consumers have a right of cancellation in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that predominantly are outside their trade, business or profession:
Right of Cancellation
You have the right to cancel this contract within thirty days without giving any reason.
The cancellation period is thirty days from the day on which you or a third party named by you who is not the carrier have taken possession of the last goods.
To exercise your right of cancellation, you must inform us (Pat’s Guitars – Patrick Walerczak, Rathausstr. 38, 52222 Stolberg, Germany, Tel.: +49 157 57180590, Email: info@patsguitars.de) by means of a clear statement (e.g. a letter sent by post or email) of your decision to cancel this contract. You may use the attached model cancellation form for this purpose, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.
Effects of Cancellation
If you cancel this contract, we shall reimburse to you all payments that we have received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within thirty days from the day on which we received notification of your cancellation of this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.
You must send back or hand over the goods to us without undue delay and in any event not later than thirty days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of thirty days has expired.
You will bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
General Notes
Please avoid damaging or contaminating the goods. Please return the goods to us in the original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.
Please do not return the goods to us freight collect (unpaid).
Please note that the above points 1–2 are not a prerequisite for the effective exercise of the right of cancellation.
No Right of Cancellation for Consignment Goods:
For items offered on consignment, there is no right of cancellation. These are sales in the name and on behalf of third parties. Pursuant to Section 312g (2) No. 1 of the German Civil Code (BGB), the right of cancellation does not apply in these cases.
No Right of Cancellation for On-Site Collection:
The right of cancellation lapses if the purchase contract is concluded only on site at our business premises and the goods are taken over directly by the buyer. In this case, there is no distance contract within the meaning of Section 312g (2) No. 9 BGB, so the statutory right of cancellation does not apply. Buyers have the opportunity to thoroughly inspect the goods before purchase.
